These Terms of Service (“Terms”) govern your access to and use of the Jumuika Hub KE platform (“Service”) operated by Jumuika Hub KE (“Company,” “we,” “us,” or “our”). By creating an account, starting a free trial, or using the Service, you agree to be legally bound by these Terms. If you do not agree, do not use the Service.
By accessing or using Jumuika Hub KE, you confirm that: You are at least 18 years old. You have authority to bind the business you represent. You agree to comply with these Terms and all applicable laws and regulations. These Terms form a legally binding agreement between you and Jumuika Hub KE.
Jumuika Hub KE is a subscription-based software platform that enables businesses to automate structured sales interactions on the WhatsApp Business API. The Service allows you to: Automate responses based on your configured product catalog. Capture and manage customer orders. Trigger secure M-Pesa STK push payment requests. Receive automated payment confirmations. Synchronize inventory based on confirmed orders. View sales and customer activity within a centralized dashboard. Jumuika Hub KE does not process payments directly. Payments are processed through Safaricom’s M-Pesa system via STK push authorization on the customer’s device. We are an independent software provider and are not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. WhatsApp Business API services are subject to Meta’s own terms and policies.
To use the Service, you must: Provide accurate and complete registration information. Maintain the security of your login credentials. Notify us immediately of unauthorized account access. You are fully responsible for: All activities conducted under your account. The accuracy of your product listings, pricing, and inventory data. Ensuring your business complies with applicable laws and WhatsApp Business policies. More specifically, businesses using the platform must ensure that customer conversations are initiated by the customer or conducted using approved WhatsApp message templates in accordance with WhatsApp Business Platform policies. We are not responsible for losses caused by unauthorized access resulting from your failure to secure your account.
We may offer a 14-day free trial. Access during the trial period may be limited or revoked at our discretion.
Paid subscriptions: Are billed monthly in advance. Renew automatically on the same calendar date each month. Continue until cancelled. You authorize us to charge your selected payment method for subscription fees.
You may cancel your subscription at any time from your dashboard. Access remains active until the end of your current billing period. No partial refunds are provided for unused time.
All subscription fees are non-refundable after activation, unless otherwise required by applicable law.
The Service depends on third-party providers including but not limited to: Meta Platforms, Inc. (WhatsApp Business API). Safaricom PLC (M-Pesa STK push). Internet service providers. Hosting infrastructure providers. You acknowledge and agree: WhatsApp Business API conversation charges are billed separately by your chosen WhatsApp provider. Jumuika Hub KE does not control Meta’s or Safaricom’s systems. We are not liable for service disruptions caused by third-party providers. Meta may suspend or restrict your WhatsApp Business account independently of our Service. Your use of third-party services is governed by their respective terms.
You agree not to use the Service to: Send unsolicited bulk messages or spam. Promote illegal goods or services. Engage in fraudulent or deceptive practices. Violate WhatsApp Business policies. Infringe intellectual property rights. Violate Kenyan laws or applicable regulations. We reserve the right to suspend or terminate accounts that violate these restrictions.
We process data in accordance with our Privacy Policy. You are responsible for: Obtaining proper consent from your customers. Complying with the Kenya Data Protection Act, 2019. Ensuring lawful handling of personal data. Upon cancellation: You may export your data during your active subscription. Data retention and deletion are governed by our Privacy Policy.
All intellectual property rights in the Service, including software, branding, design, and documentation, belong exclusively to Jumuika Hub KE. You are granted a limited, non-exclusive, non-transferable license to use the Service during your active subscription. You may not: Reverse engineer the platform. Copy or resell the software. Use our trademarks without permission.
We strive to maintain reliable access but do not guarantee uninterrupted or error-free operation. The Service is provided on an “as-is” and “as-available” basis. We may: Modify features. Suspend access for maintenance. Update the platform. We are not liable for downtime, data delays, or temporary outages.
To the maximum extent permitted by law: Jumuika Hub KE shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost revenue. Our total aggregate liability arising from your use of the Service shall not exceed the total subscription fees you paid to us in the three (3) months preceding the claim. This limitation applies regardless of the legal theory asserted.
You agree to indemnify and hold harmless Jumuika Hub KE, its directors, employees, and affiliates from any claims, damages, or liabilities arising from: Your misuse of the Service. Your violation of these Terms. Your violation of third-party rights. Your breach of applicable laws.
We may suspend or terminate your account if: You violate these Terms. You misuse the platform. Required by law or third-party platform policies. Payment is overdue. Termination does not relieve you of outstanding payment obligations.
These Terms are governed by the laws of the Republic of Kenya. Any disputes arising under these Terms shall be resolved in the courts of Kenya, unless otherwise agreed in writing.
We may update these Terms from time to time. If material changes are made, we will update the Effective Date and may notify users via email or dashboard notice. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
